Animal Cruelty on the Net gets 1st Amendment Protections!

The U.S. Court of Appeals for the 3rd Circuit (Judge Smith, presiding) on July 18, 2008 held unconstitutional the 1999 federal law that forbids selling videos of cruelty to animals. Passed in response to videos depicting women and transvestites crushing small animals with their feet (remember the spiked heel killers?)
The law was used just once before being overturned, convicted was Robert J. Stevens of Pittsville, Va. for selling videos of dog-fighting and hog-dog rodeo. His conviction was reversed by this ruling.
"Usually, videos and photographs are protected as free speech, even if they show illegal or abhorrent conduct," explainted LA Times staff writer David G. Savage,. "But in 1982, the US Supreme Court ruled that sexual depictions of children could be prosecuted as a crime despite the 1st Amendment. Government lawyers said the animal cruelty law should be upheld on the same basis.
"However," wrote Judge Brooks Smith for the majority, "preventing cruelty to animals, although an exceedingly worthy goal, simply does not implicate interests of the same magnitude as protecting children from physical and psychological harm."

You see! This is part of what is wrong in our country today. Idiot Judges! Dosent "His Honor" realize (1) that most animal abusers STARTED OUT abusing children, the elderly, and other helpless ones? Hasent he heard about "the link" between animal cruelty and violent criminals? and (2) Dosent he realize that by banning animal cruelty publications he will also be PROTECTING the children from the psychological harm they would no doubt suffer if they were to accidently view one of those animal "snuff" vids, or heaven forbid, that they grew addicted or obcessed with them, or even started immitating them on their own pets at home?

Maybe I will write this idiot judge and ask him if he has any young children and how he would like it if his kids were watching this stuff.....better yet, I'll make him a petition and say it to him in there
